Buckley Sandler Webcast: CFPB Mortgage Servicing Rules: Amendments and Exam and Enforcement Trends

On August 4, the CFPB released the long-anticipated amendments to its mortgage servicing rules under the Truth in Lending Act and Real Estate Settlement Procedures Act. In addition to expanding the scope of the loss mitigation and periodic statement requirements, and making other substantive changes that will have a significant impact on mortgage servicing systems and practices, the amendments provide clarity on the issues that servicers continue to struggle with, and offer insight into other concerns that continue to arise in examinations. Because servicers have only 12 months from publication to prepare for many of the amendments, servicers are devoting significant resources to digesting the 900 page document.
