The Future of the Community Reinvestment Act

The rules governing Community Reinvestment Act compliance, last revised in the mid-1990s, are long overdue for modernization, and the OCC, Fed, and FDIC have indicated that revisions are imminent. The OCC last fall published an advanced notice of proposed rulemaking soliciting reaction to a wide range of CRA compliance issues and since that time, the Fed and FDIC have joined the OCC in speaking publicly about revisions that could come within the year. Orrick attorney Warren Traiger discussed the OCC's ANPR and the 1,500 responses submitted by the banking industry, community advocates, and government entities, as well as what revisions appear most likely.
