California Disclosure – Employee Notice at Collection

Buckley LLP (“we,” “us,” or “Firm”) collects, maintains and uses California employee, applicant, and contractor Personal Information as listed in the below chart. For purposes of this disclosure, “Personal Information” includes information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

This disclosure is intended to comply with the California Consumer Privacy Act. The purpose of this disclosure is to provide California consumers (natural persons who are California residents) who are applicants to, employees of, or contractors of Buckley LLP with information regarding the Personal Information that Buckley LLP collects and the business or commercial purpose for which the Personal Information is collected.

Categories of Personal Information We Have Collected About Consumers  The Business or Commercial Purpose(s) for Which We Use the Personal Information
Identifiers. This may include a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, Social Security number, driver's license number, passport number, or other similar identifiers. We will use this information to conduct background checks, determine your employment eligibility, open and maintain your employee records, enroll you in Firm benefits, communicate with you for internal business purposes or emergencies, provide services to the Firm’s clients and prospective clients, detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and prosecute those responsible for that activity, debug to identify and repair errors that impair our services, and verify or maintain the quality or safety of Buckley services or devices.
Personal information described in the California Customer Records Statute (Cal. Civ. Code § 1798.80(e)). This may include a name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. We will use this information to conduct background checks, determine your employment eligibility, open and maintain your employee records, enroll you in Firm benefit programs, communicate with you for internal business purposes or emergencies, detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and prosecute those responsible for that activity, and verify or maintain the quality or safety of Buckley services or devices.
Characteristics of Protected Classification under California or Federal Law. This may include age, race, color, ancestry, national or ethnic origin, citizenship status, religion or belief, marital status, a childbirth or related medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth, and related medical conditions), sexual orientation, veteran or military status. We will use this information to comply with state and federal government record-keeping and reporting requirements, open and maintain your employee records, address our legal obligations to you, provide employment benefits to you, make any adjustments required to assist you in the performance of your role and determine whether you are fit to undertake tasks required by your job role, and provide services to the Firm’s clients and prospective clients.
Biometric information. This may include voice and video recordings. We will use a voice or video recording of you when you give a presentation for purposes of streaming or recording the presentation for others.
Internet or other similar network activity. This may include browsing history, search history, or information on a consumer's interaction with a website, application, or advertisement. We will use this information to monitor your compliance with our internal policies and procedures, investigate security breaches and misuse of computer equipment and systems, detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and prosecute those responsible for that activity, debug to identify and repair errors that impair our services, and verify or maintain the quality or safety of Buckley services or devices.
Internet or other similar network activity. This may include browsing history, search history, or information on a consumer's interaction with a website, application, or advertisement We will use a voice or video recording of you when you give a presentation for purposes of streaming or recording the presentation for others, detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and prosecute those responsible for that activity, and verify or maintain the quality or safety of Buckley services or devices.
Professional or employment-related information. This may include current or past job history or performance evaluations. We will use this information to conduct background checks, assess your qualifications for employment, conduct performance evaluations, and provide services to the Firm’s clients and prospective clients.
Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. § 1232g, 34 C.F.R. Part 99)). This may include education records directly related to a student maintained by an educational institution or party acting on its behalf, such as report cards, transcripts, class lists, student schedules, student identification codes, student financial information, and student disciplinary records. We will use this information to conduct background checks, assess your qualifications for employment, and provide services to the Firm’s clients and prospective clients.
Beneficiaries, dependents, and emergency contact information. This may include the name, gender, phone number, and relationship of beneficiaries, dependents, and emergency contacts. We will use this information to maintain your employment records, payout benefits in case of your death, and contact the designated contacts in the case of an emergency.

In addition to the uses set forth above, Buckley LLP may use and share the categories of Personal Information identified:

  • To comply with applicable legal and regulatory requests and obligations (including investigations).
  • To establish or defend legal claims and allegations.
  • For security or the prevention, detection, or investigation of fraud, suspected or actual illegal activity, violations of company policy or rules, or other misconduct. 
  • To seek advice from lawyers, auditors and other professional advisers.
