  • VA announces updates to loan repayment relief for borrowers affected by Covid-19

    On February 9, the Department of Veterans Affairs (VA) issued a circular to consolidate updates related to VA’s disaster modification and loan deferment options. Effective February 9, the circular reiterates the options for disaster modifications and loan deferment and extends the options available for borrowers affected by Covid-19 through May 31, 2024. According to the circular, a servicer can provide a VA disaster modification without VA preapproval until May 31 regardless of the borrower’s enrollment in a Covid-19 forbearance plan, or Covid-19’s impact on the default. Additionally, the VA is allowing for disaster extend modifications to extend the loan’s original maturity date by up to 18 months, instead of the standard 12 months, if the loan is modified not later than May 31. Further, subject to certain requirements and restrictions, the circular also granted servicers flexibility to offer loan deferment when borrowers have missed payments due to the pandemic, regardless of CARES Act forbearance.

  • District Court finds “negative emotions” alone do not establish standing under the FDCPA

    Recently, the U.S. District Court for the Eastern District of Missouri granted a debt collector’s motion to dismiss, finding that the plaintiff’s allegations of injury after receiving one letter that violated the FDCPA did not establish standing. The plaintiff sued the debt collector under Sections 1692e and 1692g of the FDCPA, alleging that the defendant (i) made false and misleading representations, and (ii) continued to collect the debt without proper validation by sending the plaintiff a collection letter with the wrong account number and purporting the plaintiff is personally liable for her deceased husband’s medical debt. The plaintiff asserted her injuries because of receiving the letter included expending time and money to mitigate the risk of future financial harm and fear, anxiety, and stress, which “manifested physically in the form of increased heartrate.”

    The court found that the plaintiff did not allege sufficient facts to establish, or for the court to infer, a tangible injury because the plaintiff only stated she lost money without providing additional detail on what that entailed. Additionally, the court relied on the holdings of Courts of Appeals and found that the plaintiff’s alleged emotions of fear, anxiety, and stress alone do not state a cognizable or “particularized, concrete” injury.

  • District Court receives proposed settlement agreement of $6.3 million for alleged breach of contract

    On February 6, the U.S. District Court for the Eastern District of Tennessee received the plaintiffs’ unopposed motion for preliminary approval of a class action settlement agreement as part of their lawsuit against a large bank for alleged breach of contract. According to the motion, the class action started when the plaintiffs allegedly sustained damages after the bank’s predecessor breached its contract. The contract in dispute provided consumers a high-interest market investment account that had an interest rate that was “guaranteed [to] never fall below 6.5%”; however, in 2018, the predecessor bank dropped the interest rate on all accounts below the “guaranteed” floor of 6.5 percent, down to 1.05 percent, and then to nearly zero. While the plaintiffs alleged this to be a breach of contract, the bank’s representative allegedly testified they did not have to honor the guaranteed interest rates “because the signature cards (signed by some account holders) allowed FNB to ‘adjust’ the interest rate.”

    One hundred and twenty-one plaintiffs are seeking court approval of their class action settlement. As part of the proposed settlement, plaintiffs want the defendant to pay $6.3 million to settle the class action. Additionally, the named plaintiffs want to receive $10,000 per plaintiff. The court neither granted nor denied the plaintiffs’ motion, but the defendant bank did not oppose the plaintiffs’ motion. A final hearing to consider entry of a final order is outstanding.

  • New York State Attorney General wins $77 million judgment against short-term lenders for predatory lending

    On February 8, New York State Attorney General (AG) Letitia James announced a more than $77 million judgment against three merchant cash advance (MCA) companies for usury and fraud based on allegations the lenders used short-term loans to charge illegally high-interest and undisclosed fees. 

    In a June 2020 announcement, Attorney General James detailed her office’s investigation, which concluded that the companies employed practices including (i) extending MCAs to small business owners at illegal interest rates over short durations; (ii) imposing undisclosed fees; (iii) withdrawing excess amounts from merchants’ bank accounts; and (iv) procuring judgments against merchants through the submission of falsified affidavits in New York State courts.

    The judgment follows a September 2023 court decision finding violations of New York’s prohibitions against, among other things, usury and predatory lending, and requiring the companies to cease collections and to repay thousands of small businesses the interest they paid. The companies were ordered to provide the full restitution and damages within 60 days to all merchants who entered into MCAs, including refunding all amounts taken from merchants or their guarantors in connection with the MCAs, minus the principal amounts funded to the borrowers. After the companies failed to pay the damages, the AG sought the entry of the monetary judgment from the court.

  • FTC, DFPI win MSJ against a fraudulent mortgage relief operation

    On February 13, the FTC and California Department of Financial Protection (DFPI) announced that the U.S. District Court for the Central District of California granted their motion for summary judgment against several companies and owners that the agencies alleged were operating a fraudulent mortgage relief operation. As previously covered by InfoBytes, the FTC and DFPI filed a joint complaint against the defendants in September 2022 alleging that the defendants violated the FTC Act, the FTC’s Mortgage Assistance Relief Services Rule (the MARS Rule or Regulation O), the Telemarking Sales Rule, the Covid-19 Consumer Protection Act, and the California Consumer Financial Protection Law. In granting the motion for summary judgment, the court found the defendants violated all five laws. According to the motion, the defendants falsely represented that they could lower homeowners’ interest rates and reduce the principal balances, but, after taking the payment upfront, rarely delivered any agreed-upon services. The defendants also allegedly made misleading claims during telemarketing calls with homeowners regarding home foreclosure and mortgage payments, among other claims, including with homeowners with numbers on the national Do Not Call registry.

    The court ordered the defendants to pay approximately $16 million in restitution and $3 million in civil penalties. Further, the court ordered that the defendants are subject to a (i) permanent ban on advertising, promoting, offering for sale, or selling, or assisting others in those acts, any debt relief product or service and all telemarketing; and (ii) prohibition against making misrepresentations or unsubstantiated claims regarding products or services.

  • California appeals court vacates a ruling on enjoining enforcement of CPRA regulations

    On February 9, California’s Third District Court of Appeal vacated a lower court’s decision to enjoin the California Privacy Protection Agency (CPPA) from enforcing regulations implementing the California Privacy Rights Act (CPRA).  The decision reverses the trial court’s ruling delaying enforcement of the regulations until March 2024, which would have given businesses a one-year implementation period from the date final regulations were promulgated (covered by InfoBytes here).

    The CPRA mandated the CPPA to finalize regulations on specific elements of the act by July 1, 2022, and provided that “the Agency’s enforcement authority would take effect on July 1, 2023,” a one-year gap between promulgation and enforcement. The CPPA did not issue final regulations until March of 2023, but sought to enforce the rules starting on the July 1, 2023, statutory date.  In response, in March 2023, the Chamber of Commerce filed a lawsuit in state court seeking a one-year delay of enforcement for the new regulations.  The trial court held that a delay was warranted because “voters intended there to be a gap between the passing of final regulations and enforcement of those regulations.” On appeal, the court emphasized that there is no explicit and unambiguous language in the law prohibiting the agency from enforcing the CPRA until at least one year after final regulations are approved, and that and found that while the mandatory dates included in the CPRA “amounts to a one-year delay,” such a delay was not mandated by the statutory language. The court further found that there is no indication from the ballot materials available to voters in passing the statute that the voters intended such a one-year delay. The court explained that the one-year gap between regulations could have been interpreted to give businesses time to comply, or as a period for the agency to prepare for enforcing the new rules, or there may also be other reasons for the gap.

    Accordingly, the appellate court held that Chamber of Commerce “was simply not entitled to the relief granted by the trial court.” As a result of the court’s decision, businesses are now required to commence implementing the privacy regulations established by the agency.

  • California DFPI proposes new regulations under the Debt Collection Licensing Act

    On February 9, the California Department of Financial Protection and Innovation (DFPI) published a proposed rule to adopt new regulations under the Debt Collection Licensing Act (DCLA). Under the DCLA, a debt collector licensee is required to pay the DFPI Commissioner its “pro rata share of all costs and expenses incurred in the administration” of the DCLA, which is calculated in part based on the licensee’s “net proceeds generated by California debtor accounts,” but the term “net proceeds” was not defined in the statute. The proposed rule defines “net proceeds generated by California debtor accounts” to mean “the amount retained by a debt collector from its California debt collection activity.” The proposed rule also specifies the formulas used in calculating the net proceeds depending on the party, including a debt buyer, purchaser of debt that has not been charged off or in default, third-party collector, and first-party collector.

    Additionally, the proposed rule requires licensees to file an annual report with the DFPI and specifies the information required in the annual report, including (i) the number of California debtor accounts collected on in the previous year; (ii) the number of California debtor accounts in the licensee’s portfolio as of December 31 of the preceding year; and (iii) the number and dollar amount of California debtor accounts for which collection was attempted, but not successfully collected or resolved during the previous year. Comments to the proposed rule must be submitted by March 27.

  • FFIEC releases statement on examination principles related to discrimination and bias in residential lending

    On February 12, the Federal Financial Institutions Examinations Council (FFIEC) released a statement on “Examination Principles Related to Valuation Discrimination and Bias in Residential Lending.” The statement outlined principles that examiners should use to evaluate an institution’s residential property appraisal and valuation practices to mitigate risks that stem from (i) discrimination “based on protected characteristics in the residential property valuation process, and (ii) bias, defined as “a preference or inclination that precludes an appraiser or other preparer of the valuation from reporting with impartiality, independence, or objectivity” as required by the Uniform Standards of Professional Appraisal Practice. Failure to have these internal controls to identify and address discrimination or bias can result in poor credit decisions, consumer harm, increased safety and soundness risk. The principles outlined by the statement are categorized into consumer compliance examination principles and safety and soundness principles. For consumer compliance, examiners should consider an institution’s (i) board and senior management oversight to determine if it is commensurate with the institution’s risk profile; and (ii) consumer compliance policies and procedures to identify and resolve potential discrimination. The principles during a safety and soundness examination should include reviewing the consumer protection issues, governance, collateral valuation program, third-party risk management, valuation review, credit risk review, and training programs.

  • SEC Chair Gensler weighs in on AI risks and SEC’s positioning

    On February 13, SEC Chair Gary Gensler delivered a speech, “AI, Finance, Movies, and the Law” before the Yale Law School. In his speech, Gensler spoke on the crossovers between artificial intelligence (AI) and finance, system-wide risks on a macro-scale, AI offering deception, AI washing, and hallucinations, among other topics.

    Gensler discussed the benefits of using AI in finance, including greater financial inclusion and efficiencies. However, he highlighted that the use of AI amplifies many issues, noting how AI models can be flawed in making decisions, propagating biases, and offering predictions. On a system-wide level, Gensler opined how policy decisions will require new thinking to overcome the challenges to financial stability that AI could create.  Gensler addressed AI washing, stating that it may violate securities laws, emphasizing that any disclosures regarding AI by SEC registrants should still follow the “basics of good securities lawyering” for disclosing material risks, defining the risk carefully, and avoiding disclosures that could mislead the public regarding the use of an AI model. Lastly, Gensler warned about AI hallucinations, saying that advisors or brokers are not supposed to give investment advice based on inaccurate information, closing with “You don’t want your broker or advisor recommending investments they hallucinated while on mushrooms.”

  • Yellen testifies on FSOC Annual Report, key areas of focus

    On February 8, the U.S. Senate Committee on Banking, Housing, and Urban Affairs held a hearing titled “The Financial Stability Oversight Council Annual Report to Congress” with testimony provided by U.S. Treasury Secretary Janet Yellen. Secretary Yellen discussed progress, and continued focus, related to five topics addressed in FSOC’s 2023 Annual Report (covered by InfoBytes here): capital risks posed by nonbank financial institutions; climate-related financial stability risks; cybersecurity risks; monitoring artificial intelligence (AI) use in financial services; and digital asset oversight. In response to questioning from Senator Cortez Masto (D-NV), Yellen discussed how FSOC highlighted that about 70 percent of single-family mortgages were originated by nonbank mortgage originators during the first half of 2023. When Secretary Yellen was asked if the shift from banks to nonbanks in the mortgage space poses a financial stability risk “due to non-banks’ lack of access to deposits,” she responded that FSOC is “very focused” on the issue since non-banks are reliant on short-term financing. In addition, Yellen spoke about AI and learning its impact on vulnerabilities and risk, as well as the Basel III proposal, urging regulators to “finalize these rules as quickly as possible.”
