Kansas extends professional and occupational license renewal deadlines
On April 9, Kansas Governor Laura Kelly issued an executive order extending the renewal deadlines for all occupational or professional licenses, certificates, permits, or registrations issued by a state agency. Such licenses/registrations/etc. will remain valid until 90 days following the termination of the statewide state of emergency. However, the order does not affect licensing for attorneys.
Kansas governor authorizes remote online notarization
On April 9, Kansas Governor Laura Kelly issued an executive order temporarily allowing remote online notarization as long as it meets certain conditions and follows the regulations outlined by the secretary of state and noted in the executive order. The order remains in effect until May 1, or until the statewide state of emergency expires.
Kansas Department of Credit Unions releases list of Covid-19 resources
On March 23, the Kansas Department of Credit Unions issued a statement to Kansas chartered credit unions including a list of Covid-19 resources that may be helpful. The list includes resources from both the federal government and the state of Kansas.
Kansas governor halts certain foreclosures and evictions
On March 23, the Kansas governor ordered that no bank or financial entity lending in Kansas could foreclosure on a residential property if all defaults or violations of the mortgage “are substantially caused by a financial hardship resulting from the Covid-19 pandemic.” In addition, the order precludes landlords from evicting residential tenants when all violations or defaults of the rental agreement are caused by financial hardship resulting from Covid-19. The order does not prohibit the continuation of evictions or foreclosures filed prior to March 23, or for foreclosures or evictions relating to borrowers or tenants who have not suffered a financial hardship resulting from Covid-19. The prohibition remains in effect until it is rescinded or the state of emergency is lifted.
Kansas governor suspends foreclosures
On March 17, the Kansas governor announced Executive Order #20-06, which directs all financial institutions operating in Kansas to temporarily suspend the initiation of any mortgage foreclosure efforts or judicial proceedings and any commercial or residential eviction efforts or judicial proceedings until the earlier of May 1, 2020, or the expiration of the State of Disaster Emergency proclamation.
Kansas Office of the State Bank Commissioner issues work from home guidance
On March 16, the Kansas Office of the State Bank Commissioner (OSBC) issued temporary guidance allowing licensed mortgage companies, mortgage loan originators, supervised loan licensees, credit services organizations, money transmitters, credit notification registrants and their employees to work remotely due to the Covid-19 crisis. Licensed or registered individuals and entities will be allowed to work from their residences or a company designated location--even if the residence or location is not a licensed or registered branch location--providing they have temporary policies, procedures, and a plan for supervision in place. OSBC also set forth best practices for remote work to ensure that security of information is maintained.
Kansas Department of Credit Unions issues guidance on postponement of annual meetings
On March 16, the Kansas Department of Credit Unions issued a bulletin providing that credit union boards of directors have the discretion to postpone the annual meeting indefinitely based on the Kansas governor’s state of disaster emergency declaration. The board should contact legal counsel to determine the appropriate procedures to be implemented for such meetings.
Kansas Office of the State Bank Commissioner temporarily closed
On March 16, the Kansas Office of the State Bank Commissioner (OSBC) announced it would be closed until March 23 with staff working remotely. In addition, all OSBC on-site exams have been suspended at least until the end of March. The OSBC suggested visiting their website (www.osbckansas.org) for additional information regarding temporary bank closures and relocations.
Kansas Department of Credit Unions issues guidance on pandemic planning
On March 11, the Kansas Department of Credit Unions issued guidance to Kansas-chartered credit unions on pandemic planning. The guidance outlines areas and objectives that should be met by a credit union’s business continuity plan. Among other things, the guidance encourages credit unions to have a comprehensive framework of facilities, systems, or procedures to provide the organization with the capability to continue its critical operations in the event that staff members may be unavailable for prolonged periods.
