  • OCC Acting Deputy Comptroller Murphy testifies on OCC’s Office of Financial Technology

    On December 5, the Acting Deputy Comptroller of the OCC’s Office of Financial Technology, Donna Murphy, testified before the U.S. House Subcommittee on Digital Assets, Financial Technology and Inclusion. Her testimony focused on the OCC’s supervision and regulation of new and emerging fintech products.

    Created in October 2022, the Office of Financial Technology regulates and supervises all aspects of fintech innovation in the federal banking system, including bank-fintech partnerships, artificial intelligence, and digital assets. Murphy testified that a strong risk management plan against third parties is essential. She referenced the joint guidance issued earlier this year by the OCC, Federal Reserve, and FDIC (previously covered by InfoBytes, here).

    Murphy also discussed the use of artificial intelligence and algorithms in banking, highlighting the many ways they can strengthen safety and soundness, enhance consumer protection, improve compliance, address financial crime, and increase fairness and access to the banking system. However, Murphy highlighted the need for banks to focus on software design, testing, security, and data management when implementing artificial intelligence. Lastly, Murphy iterated the OCC’s commitment to reducing inequality in banking and increasing access to financial services for all.

  • FHFA reports no internal control weaknesses FY 2023 performance report

    On November 15, FHFA released its annual performance report, titled “FHFA FY 2023 Performance and Accountability Report” to detail how it regulated the FHLBank system, as well as Fannie Mae and Freddie Mac, during the past fiscal year. The report refers to its FY 2022-2026 Strategic Plan with the goals of securing the safety of regulated entities, fostering equitable housing finance markets, and stewarding FHFA’s infrastructure. For FY 2023, FHFA identified 35 performance targets to help guide it toward achieving its strategic goals. Of the 35 targets, the FHFA met 31 of them––an 89 percent success rate. Table 2 from page 15 of the report displays the goals and ones that have not been met, including (i) “Improve Time-to-Hire” within 80 days; and (ii) “Develop FHFA Information Technology Strategic Plan” by the time the report had been published.

    Looking forward, FHFA wishes to implement an “Enterprise Fair Lending Rating System to annually assess each Enterprise’s compliance with fair lending and fair housing standards.” For fintech initiatives, FHFA will publish a summary on Velocity TechSprint, a problem-solving event with “mortgage industry leaders and fintech entrepreneurs to address mortgage market issues.”

  • NY Fed highlights an increase in unsecured loans from fintech firms in report, primarily among subprime lenders

    On November 21, the Federal Reserve Bank of New York released a report on the rise and then contraction of unsecured personal loans from 2019 to 2023 for nonbank or fintech companies, and the role of alternative data and underwriting in that growth.

    The report looked at how the economic conditions from 2019 to 2022 “created an ideal environment for FinTech firms to increase their loan originations.” It specifically noted that the U.S. government-issued stimulus payments and student loan repayment moratorium enabled fintech companies to expand their services to low- and moderate-income borrowers, including those with subprime credit. The report also looked at fintech’s role in that growth, what consumer segments are utilizing unsecured personal loans, the overall growth of the products, and the subsequent tightening of credit. Finally, the NY Fed discussed various fintech models and analyzed which models service the needs of low- and moderate-income households.

  • NYDFS introduces guidelines for coin-listing and delisting policies in virtual currency entities

    On November 15, NYDFS announced new regulatory guidance which adopts new requirements for coin-listing and delisting policies of DFS-regulated virtual currency entities, updating its 2020 framework for each policy. After considering public comments, the new guidance aims to enhance standards for self-certification of coins and includes requirements for risk assessment, advance notification, and governance. It emphasizes stricter criteria for approving coins and mandates adherence to safety, soundness, and consumer protection principles. Virtual currency entities must comply with these guidelines, requiring DFS approval for coin-listing policies before self-certifying coins, and submitting detailed records for ongoing compliance review. The guidance also outlines procedures for delisting coins and necessitates virtual currency entities to have an approved coin-delisting policy.

    As an example under coin listing policy framework, the letter states that a virtual currency entity risk assessment must be tailored to a virtual currency entity's business activity and can include factors such as (i) technical design and technology risk; (ii) market and liquidity risk; (iii) operational risk; (iv) cybersecurity risk; (v) illicit finance risk; (vi) legal risk; (vii) reputational risk; (viii) regulatory risk; (ix) conflicts of interest; and (x) consumer protection. Regarding consumer protection, NYDFS says that virtual currency entities must “ensure that all customers are treated fairly and are afforded the full protection of all applicable laws and regulations, including protection from unfair, deceptive, or abusive practices.”

    Similar to the listing policy framework, the letter provides a fulsome delisting policy framework. The letter also stated that all virtual currency entities must meet with the DFS by December 8 to preview their draft coin-delisting policies and that final policies must be submitted to DFS for approval by January 31, 2024.

  • SEC and DOJ charge two co-CEOs operating a $100 million fraud scheme

    On November 9, the SEC and DOJ charged two co-CEOs of a tech investment firm for allegedly directing a $100 million fraud scheme. The two individuals were the founders of a failed Fresno-based technology company and were charged with “conspiring to commit wire fraud and taking more than $100,000,000 from various businesses and individuals” under U.S.C. § 1349. The two founders allegedly misled investors through falsified documents, bank records, auditing reports, and accounting statements.

    The DOJ alleges that, as recently as January 2022, “[the two individuals lied] to board members, investors, lenders, and others about [the company’s] finances to obtain investments, loans, and other funding… Much of the money went towards paying payroll, including the [co-CEOs’] $600,000 per year salaries.” Authorities discovered the alleged fraud scheme back in May 2023 when the company failed to make payroll and then terminated all its 900 employees. If convicted, the two founders face a maximum statutory penalty of 20 years in prison each and a $250,000 fine.

  • CFPB proposes a rule to regulate fintech firms like banks

    On November 7, the CFPB proposed a rule to supervise large non-bank fintech firms that offer services like digital wallets and payment apps, applicable to larger firms handling greater than 5 million transactions per year, in the same way many large banks and credit unions are supervised. While fintech agencies offer consumer banking services, they are not regulated as stringently as banks are.

    The CFPB found that many consumers from middle- and lower-income backgrounds now prefer using digital consumer payment applications over cash. This shift from traditional banking puts consumers at risk since fintech  applications are not subject to “traditional banking safeguards… like deposit insurance.” The CFPB’s proposed rule ensures these non-bank companies:

    • Adhere to federal consumer financial protection laws that encompass protections against unfair, deceptive, and abusive practices, consumers’ rights when transferring money, and privacy rights. The CFPB would supervise larger participants to ensure compliance.
    • Follow the same rules as banks and credit unions, fostering fair competition and consistent enforcement of federal consumer financial protection laws.

    The Consumer Financial Protection Act (CFPA) provides the CFPB with the authority to conduct supervisory examinations over all non-bank companies in the mortgage, payday loan, and private student loan industries, as well as those who serve as service providers to banks and credit unions. In addition, the CFPB can supervise individual entities that pose a risk to consumers, as well as larger participants in other markets. This proposed rule would give the CFPB greater regulatory authority and oversight over large technology firms in consumer financial markets.

  • FSOC approves analytic framework for financial stability risks and guidance on nonbank financial company determinations

    On November 3, the Financial Stability Oversight Council (FSOC) announced that it unanimously voted to issue the final versions of a new analytic framework regarding financial stability risks, in addition to updated interpretive guidance on the council’s nonbank designation guidance. The analytic framework indicates vulnerable points that commonly contribute to financial stability risks, and it explains how FSOC may address the risks, including interagency coordination, recommendations to regulators, or the designation of certain entities. The nonbank designation guidance establishes how the council determines whether a given nonbank should be under the Fed’s supervision and prudential standards under Section 113 of Dodd-Frank. In April, FSOC released the proposed analytic framework and the proposed nonbank designation guidance (as covered by InfoBytes here) and opened a comment period on the proposals.

    FSOC adopted key changes in consideration of public comments on the proposed framework, including (i) clarifications to the interpretation of “threat to financial stability”; (ii) more examples of quantitative metrics considered in its analysis; (iii) expanded discussion of transmission channels; and (iv) additional emphasis on FSOC’s engagement with state and federal financial regulatory agencies regarding risk. Comments directed at the interpretive guidance were addressed, and some changes are reflected in the framework. Both CFPB Director Rohit Chopra and OCC Acting Comptroller Michael J. Hsu issued statements supporting the issuance of the interpretive guidance and the framework. Chopra commented that FSOC’s actions to evaluate whether any “shadow bank” meets the statutory threshold for enhanced oversight are essential in preventing potential threats to financial stability. Hsu also noted the significance of leveraging Dodd-Frank's tools for “monitoring and mitigating risks to U.S. financial stability.”

    The analytic framework will be effective upon publication in the Federal Register, and the nonbank designations guidance will be effective 60 days after publication in the Federal Register.

  • Fed’s Vice Chair remarks on payments innovation, CBDCs, and financial inclusion

    On October 27, Fed Vice Chair for Supervision, Michael Barr, delivered a speech at the Economics of Payments XII Conference discussing the Fed’s place in the payments system and highlighting its role as a bank supervisor and operator of key payment infrastructure. Emphasizing the Fed’s introduction of its FedNow instant payment service (covered by InfoBytes here), which was designed to enable secure instant payments in response to the increasing demand for secure and convenient payment options, Barr encouraged banks to build upon the new payment infrastructure. He also noted that ongoing experimentation with new payment technologies, such as stablecoins, creates a need for regulation, particularly where an asset is “pegged to government-issued currencies.” 

    Regarding central bank digital currencies (CBDCs), the Fed is engaged in research and in discussions with various stakeholders; however, it has not decided on whether to issue a CBDC. The Vice Chair stressed that any move in this direction would require “clear support” from the Executive Branch and authorization from Congress.

    Barr emphasized the Fed’s commitment to working with the international community to improve cross-border payment systems as well as the need for research into both traditional and emerging payment methods, noting that innovation should “promote broad access and financial inclusion.”  Finally, the remarks touched on the Fed’s proposed revisions to the interchange fee cap for debit card issuers, with a call for public input on the matter (covered by InfoBytes here).

  • U.S.-UK partnership discuss fintech innovation

    On October 30, the U.S. Treasury Department issued a joint statement on behalf of the U.S.-UK Financial Innovation Partnership (FIP) providing an overview of recent meetings where Regulatory and Commercial Pillar participants exchanged views on “topics of mutual interest and to deepen ties between U.S. and UK financial authorities on financial innovation.” As previously covered by InfoBytes, the FIP was created in 2019 as a way to expand bilateral financial services collaborative efforts, study emerging fintech innovation trends, and share information and expertise on regulatory practices. Discussions focused on four topic areas: (i) cryptoassets; (ii) payment system modernization; (iii) distributed ledger technology; and (iv) artificial intelligence. Participants recognized “the continued importance of their partnership on financial innovation as an integral component of U.S.-UK financial services cooperation.” Participants also noted a desire to continue discussing these topics ahead of the next meeting in 2024.

  • CFPB announces civil money penalty against nonbank, alleges EFTA and CFPA violations

    On October 17, the CFPB announced an enforcement action against a nonbank international money transfer provider for alleged deceptive practices and illegal consumer waivers. According to the consent order, the company facilitated remittance transfers through its app that required consumers to sign a “remittance services agreement,” which included a clause protecting the company from liability for negligence over $1,000. The Bureau alleged that such waiver violated the Electronic Fund Transfer Act (EFTA) and its implementing Regulation E, including Subpart B, known as the Remittance Transfer Rule, by (i) requiring consumers sign an improper limited liability clause to waive their rights; (ii) failing to provide contact and cancellation information in disclosures, and other required terms; (iii) failing to provide a timely receipt when payment is made for a transfer; (iv) failing to develop and maintain required policies and procedures for error resolution; (v) failing to investigate and determine whether an error occurred, possibly preventing consumers from receiving refunds or other remedies they were entitled to; and (vi) failing to accurately disclose exchange rates and the date of fund availability. The CFPB further alleged that the company’s representations regarding the speed (“instantly” or “within seconds”) and cost (“with no fees”) of its remittance transfers to consumers were inaccurate and constituted violations of CFPA. The order requires the company to pay a $1.5 million civil money penalty and provide an additional $1.5 in consumer redress. The company must also take measures to ensure future compliance.
