McGinn was extensively quoted in a three-part series in Cybersecurity Law Report, “The Rise of Facial Recognition Technology,” which discussed the uses, risks, and legal framework governing FRT. McGinn noted “If a company experiences a breach and has biometric data customers residing in a state with a breach notification law that covers biometric data, it will need to notify consumers and potentially answer to regulators or the state attorney general regarding what biometric data was compromised and the information security policies it had in place to protect that data prior to the compromise.”
