HuttenBenjamin Hutten was extensively quoted on October 19, 2020, in a Capitol Forum article, “New Fortress Energy: Contract with Nicaraguan company with strong ties to sanctioned entity and unknown ownership raises red flags, potentially exposing New Fortress to legal risk, experts say,” which discussed the contract between the two entities, and the need for New Fortress to be aware of the ramifications of the relationship.
Hutten noted, “Without knowing who the divestiture was made to, in addition to the fact that its potentially operated by a Specially Designated National, it’s hard to understand how a U.S. entity would feel comfortable dealing with the party in question. It would take a great deal of diligence, with supporting documents and information, and expansive oversight and control over the company’s business with Disnorte-Dissur to feel confident about ongoing compliance.”
