Peter Olszewski helps financial services companies and institutions ensure that their businesses, products and services comply with applicable state and federal consumer credit laws. He has been involved in numerous multistate analyses of mortgage and consumer lending laws and is well-versed in the areas of state licensing, disclosures, usury and interest rate exportation.

Peter has a multifaceted regulatory practice and advises on a broad range of issues confronting the financial services industry, including:

  • Assisting with the implementation of effective compliance management systems to keep up with ever-evolving regulatory requirements and standards
  • Counseling financial institutions on federal laws governing consumer credit transactions, including the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA), the Fair Debt Collection Practices Act (FDCPA) and other laws enforced by the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC)
  • Analyzing state licensing requirements applicable to consumer and commercial lenders, brokers, servicers and debt collectors
  • Working with clients to identify and prevent practices that could be deemed unfair, deceptive or abusive (UDAAPs)
  • Advising lenders in connection with the development of online point-of-sale platforms and related technology
  • Conducting “true lender” risk assessments of bank partnership origination models utilized by marketplace and other online lenders, and performing due diligence reviews of origination and servicing platforms and loan portfolios
  • Advising financial institutions on requirements applicable to sales of charged-off debt and helping sellers structure debt sale programs and transactions in line with regulatory expectations

Prior to joining Orrick, Peter served as senior counsel at Buckley LLP. He also was senior regulatory counsel at Promontory MortgagePath LLC, where he focused on proprietary technology development. Previously he was an attorney at the FTC’s Office of the General Counsel.

    • Regulatory due diligence of marketplace lending company on behalf of investors in whole loans originated through company’s platform
    • Multi-state review of disclosure requirements, fee limits, loan term restrictions and other provisions applicable to private student loans made by non-depository lender
    • Review and risk assessment focusing on cross-sales of insurance products by mortgage lender and its affiliates
    • Analysis of consumer loan transfer restrictions applicable to loans used to secure commercial credit facility
    • Most-favored-lender analysis of state usury and fee limits on behalf of client seeking national bank charter
