  • CFPB Issues TRID FAQs to Help Borrowers Understand the New Mortgage Process

    On October 5, the CFPB posted on its blog six FAQs to assist borrowers in understanding the TRID rule and how the new process attempts to make the mortgage process easier. The post comes in light of the TRID rule becoming effective on October 3 and addresses the new required federal disclosures for most mortgages, along with lenders’ requirement to provide a Closing Disclosure at least three business days before consummation. The FAQs also clarify instances where a second three-day review period is required once a Closing Disclosure is received.

  • OFAC Updates Cuban Assets Control Regulations Easing Sanctions on Cuba

    On September 18, OFAC issued a final rule amending the Cuban Assets Control Regulations (CACR) to reflect policy changes previously announced by the Obama administration. With respect to financial transactions, the amendments, among other things, (i) permit certain additional persons subject to U.S. jurisdiction to open and maintain bank accounts in Cuba to use for authorized purposes; (ii) removes limitations on donative remittances to Cuban nationals, on certain authorized remittances that authorized travelers may carry to Cuba, and on the amount of remittances that a Cuban national permanently resident in Cuba who is departing from the U.S. may carry to Cuba; (iii) adds a new general license authorizing remittances from Cuba and Cuban nationals to the United States; (iv) adds a new general license authorizing the unblocking and return of certain previously blocked remittances and funds transfers in certain circumstances; and (v) authorizes U.S. depository institutions to maintain accounts for Cuban nationals while the Cuban-national account holder is located outside the United States, provided that the account holder may only access the account while lawfully present in the United States, and removes a cap on payments from blocked accounts held by Cuban nationals in the United States in a nonimmigrant status to use for living expenses. The amendments also relax restrictions previously set forth in the telecommunications and internet sector, on travel between the U.S. and Cuba, and other various activities. Revisions to the CACR take effect on September 21, 2015.

    At the same time, OFAC published a set of new and revised FAQs addressing the changes set forth in the updated CACR.

  • Update: OFAC Releases Guidance on the Continuation of Certain Temporary Sanctions Relief Under the JPOA

    On July 10, the P5 + 1, and Iran agreed to extend the JPOA for three days to further negotiations in reaching a comprehensive solution surrounding Iran’s nuclear program. As a result, OFAC issued updated guidance informing that all JPOA sanctions relief detailed in the Guidance, FAQs, and Statement of License Policy issued in November 2014 has been extended through July 13, 2015. This updated guidance replaces guidance previously issued by OFAC on July 7, 2015.

  • HUD Finalizes Rule on Affirmatively Furthering Fair Housing

    On July 8, HUD issued a final rule aimed at helping communities who receive HUD funding meet their fair housing obligations to provide affordable housing in more communities. The rule equips grantees with various new data and tools to better analyze the state of fair housing within their communities, and assist grantees in setting locally-determined benchmarks. The rule also requires new reports from local communities detailing how HUD funds will be allocated, and provides a phase-in period for grantees to adapt to the new requirements. In conjunction with the issuance of the final rule, HUD also released an Executive Summary, a fact sheet, and FAQs to provide greater clarity and support to grantees.

  • Update: OFAC Releases Guidance on the Continuation of Certain Temporary Sanctions Relief Under the JPOA

    On July 7, the P5 + 1, EU, and Iran agreed to extend the JPOA for three days to further negotiations in reaching a comprehensive solution surrounding Iran’s nuclear program. As a result, OFAC issued updated guidance informing that all JPOA sanctions relief detailed in the Guidance, FAQs, and Statement of License Policy issued in November 2014 has been extended through July 10, 2015. This updated guidance replaces guidance previously issued by OFAC on June 30, 2015.

  • OFAC Releases Guidance on the Continuation of Certain Temporary Sanctions Relief Under the JPOA

    On June 30, the P5 + 1, European Union, and Iran agreed to extend the Joint Plan of Action for seven days, furthering negotiations to reach a solution to reduce Iran’s nuclear program.  In conjunction with the announcement of the seven day extension, OFAC published Guidance on the Continuation of Certain Temporary Sanctions Relief Implementing the Joint Plan of Action, as Extended. The guidance continues the JPOA sanctions relief period, provided in November 2014 as implemented via Guidance, FAQs, and Statement of Licensing Policy, from June 30 through July 7, 2015.

  • August 10 Deadline Set for New York Virtual Currency Firms to Apply for BitLicense

    On June 24, the New York State Register published the Department of Financial Services’ BitLicense framework, requiring companies and individuals who provide virtual currency services involving New York or a New York Resident to apply for a BitLicense by August 10, 2015. Virtual currency firms must submit the 31-page application providing information including, among other things, (i) written policies and procedures including, but not limited to BSA/AML, cybersecurity, privacy and information security, (ii) company information, (iii) biographical information on company directors and stockholders, and (iv) an explanation of the methodology used to calculate the value of virtual currency in fiat currency. In addition, the NYDFS released a set of FAQs to help clarify the BitLicense requirements.

  • FHFA Releases Fannie and Freddie's New Eligibility Requirements for Seller/Servicers

    On May 20, the FHFA announced that Fannie Mae and Freddie Mac released updates to their operational and financial eligibility requirements for single-family mortgage Seller/Servicers. Because of changes in the servicing industry, the FHFA directed Fannie and Freddie to update their Seller/Servicer standards to “help ensure the safe and sound operation of the Enterprises and provide greater transparency, clarity and consistency to industry participants and other stakeholders and reflect feedback received over the past several months.” Fannie Mae’s revised operational standards will take effect by September 1, 2015, and Servicers must implement the financial eligibility changes by December 31, 2015. Operational standards for Freddie Mac Servicers will take effect August 18, 2015; financial eligibility revisions must be in place by December 31, 2015.

  • OFAC Publishes Guidance Regarding Travel Between U.S. and Cuba, Releases Updated FAQs Regarding Cuba-Related Sanctions

    On May 5, OFAC issued new Guidance Regarding Travel Between the U.S. and Cuba, which provides information on the types of individuals and cargo that can be transported between the U.S. and Cuba by a licensed air carrier or commercial passenger vessel. With respect to individuals, the guidance addressed persons subject to U.S. jurisdiction, Cuban nationals, and other individuals, including foreign nationals, travelling on official government business.  The guidance regarding cargo addressed, among other things, alcohol and tobacco products.  In a separate announcement released on April 16 (and later updated on May 5), OFAC issued new and updated Frequently Asked Questions (FAQs) related to the Cuban Assets Control Regulations (CACR). The updated FAQs follow a January 15 announcement in which OFAC issued a final rule amending the CACR to reflect policy changes previously announced by President Obama in 2014.

  • Federal Banking Regulators Issue FAQs on the Regulatory Capital Rule

    On April 6, three prudential banking regulators – the Federal Reserve, OCC, and FDIC – issued interagency guidance to clarify and answer questions from regulated financial institutions with respect to the regulatory capital rule adopted in 2013. The FAQs address various topics, including (i) the definition of capital; (ii) high-volatility commercial real estate exposures; (iii) other real estate and off-balance sheet exposures; (iv) separate account and equity exposures to investment funds; (v) credit valuation adjustment; and (vi) the definition of a qualifying central counterparty.
