Maryland Department of Labor issues financial relief guide for Marylanders
On June 19, the Maryland Department of Labor’s Office of the Commissioner of Financial Regulation issued the Covid-19 Health Crisis: Financial Relief Guide for Marylanders. Among other things, the guide contains information and resources regarding relief programs for consumers relating to economic impact payments, mortgage payments and foreclosure, rental evictions, student loans, automobile and personal loans, collections and garnishment, credit reporting, and insurance coverage and payments.
FHA extends foreclosure and eviction moratorium for two more months
On June 17, FHA announced that it will extend its foreclosure and eviction moratorium through August 31, 2020, which applies to homeowners with FHA-insured Title II Single Family forward and Home Equity Conversion (reverse) mortgages, excluding legally vacant or abandoned properties (previously discussed here and here). The announcement also reminds servicers of their obligations under the CARES Act.
FHFA: Fannie Mae and Freddie Mac will extend foreclosure and eviction moratorium
On June 17, FHFA announced that Fannie Mae and Freddie Mac will extend their single-family moratorium on foreclosures and evictions until at least August 31, which is currently set to expire on June 30 (previously discussed here). The foreclosure moratorium applies to homeowners with an Enterprise-backed, single-family mortgage.
Michigan governor extends eviction moratorium
On June 11, the Michigan governor issued Executive Order 2020-118, which extends the state’s eviction moratorium, previously covered here, through June 30. During this period, a person may not be removed or excluded from leased residential premises or residential premises held under a forfeited executory contract, subject to certain exceptions. The executive order also stays any statutory limits on Michigan courts’ ability to adjourn any proceedings, toll any redemption periods or limitations periods, or extend any deadlines until 30 days after the restrictions on eviction expire.
Virginia announces temporary moratorium on evictions
On June 8, Virginia announced a temporary moratorium on residential eviction proceedings through June 28. The order suspending evictions remains in effect through June 28. Eviction proceedings are halted for a period of almost three weeks while the governor implements a rent relief program.
Minnesota clarifies earlier executive order regarding evictions
On June 5, the Minnesota governor issued Executive Order 20-73, which clarifies an earlier executive order, previously covered here, that suspends evictions and writs of recovery during the Covid-19 outbreak. The executive order adds an exception to the moratorium on evictions where a tenant seriously endangers the safety of others on the premises, or poses a danger to others who are not residents, if the serious endangerment of others who are not residents is a material violation of the lease.
Florida extends foreclosure and eviction moratoriums until July 1
On June 1, Florida’s governor issued Executive Order Number 20-137 extending the state’s foreclosure and eviction moratorium (previously covered here) until July 1.
Rhode Island courts to recommence eviction proceedings on June 2, 2020
On May 20, State of Rhode Island District Court issued Administrative Order 2020-02, announcing that it would recommence adjudicating eviction matters on June 2, and detailing a set of temporary practices and protocols for eviction matters. Similarly, on May 19, the State of Rhode Island Department of Business Regulation issued Certified Constables Bulletin 2020-1.2, noting that certified constables should conduct service of process and executions regarding eviction at a time and in a manner specified by the court.
Michigan prohibits removal or exclusion of tenant or mobile home owner from their home
On May 14, the Michigan governor issued an executive order temporarily prohibiting the entry to premises to remove or exclude a tenant or mobile home owner from their home, except for certain limited reasons. While the executive order does not prohibit a landlord or vendor from receiving payment or making a demand for rent or executory contract payment, such a demand may not include a threat of possession or forfeiture based on nonpayment. Officers also may not serve process requiring forfeiture of leased residential premises or residential premises held under a forfeited executory contract. The prohibitions are effective immediately and will continue until June 11, 2020, at 11:59 p.m. Further, until 30 days after any restrictions on eviction in the executive order expire, any statutory limits on the Michigan courts to adjourn proceedings, toll redemption periods or limitations periods, or extend any deadlines, are suspended.
FHA issues mortgagee letter on extension of foreclosure and eviction moratoriums
On May 14, FHA issued Mortgagee Letter 2020-13, which extends the foreclosure and eviction moratorium in connection with the Covid-19 emergency and issues new reporting requirements related to FHA single family’s CARES Act loss mitigation options. The foreclosure moratorium is extended to June 30, 2020, and applies to FHA-insured single family mortgages, except vacant or abandoned properties. The moratorium on evictions of persons from properties securing FHA-insured single family mortgages, excluding actions to evict occupants of legally vacant or abandoned properties, is also extended for the same period. The bulletin also provides guidance on how mortgagees must report the Default/Delinquency Reason Codes that apply to the borrower at the end of each reporting cycle. The mortgagee must update the code as the borrower’s circumstances change.
